1. Acceptance of terms
By accessing the zytek.app website or using any service from Zytek LLC (“Zytek”, “we”), you accept these Terms of Service in their entirety. If you do not accept these terms, please do not use our services.
These terms constitute a binding legal agreement between you and Zytek LLC, a limited liability company registered in the state of South Carolina, United States.
2. Service description
2.1 Digital Marketing Services
Zytek offers professional digital marketing services including:
- Social Media: social media management, content and community management
- Ads: digital advertising on Meta, Google and TikTok
- Integrated Marketing: 360° solution with strategy, branding, web and campaigns
2.2 ZytekOS (SaaS)
ZytekOS is our software-as-a-service (SaaS) platform for restaurants, retail and services. It includes 4 subscription tiers (Lite, Basic, Pro, Enterprise) with increasing features. At the time of publication of these terms, ZytekOS is under construction with a scheduled launch date of 2026.
3. User accounts
To access certain services, you may need to create an account. You are responsible for maintaining the confidentiality of your credentials and for all activities under your account. Notify us immediately if you suspect unauthorized use.
4. Payments and subscriptions
4.1 Marketing services
- Recurring monthly services billed at the start of the cycle
- One-time projects paid upon starting the work
- Cancellation with 30 days notice for recurring services
4.2 ZytekOS Subscriptions
- Recurring automatic monthly billing
- Automatic renewal at the end of each cycle, unless cancelled
- Cancellation effective at the end of the current billing cycle
- 14-day satisfaction guarantee (see Refund Policy)
4.3 Accepted payment methods
We accept credit card (processed by Braintree), Zelle, PayPal, USDT, Wire/ACH and Western Union. Details at Payment Methods.
5. Price changes
We reserve the right to modify prices with 60 days notice for existing subscriptions. Changes will apply to the next billing cycle after notice.
6. Acceptable use policy
By using our services, you commit to NOT:
- Conduct illegal or fraudulent activities
- Violate third-party rights (intellectual property, privacy, etc.)
- Distribute spam, malware or malicious content
- Interfere with the operation of the platform
- Use the services to directly compete with Zytek
- Share credentials with unauthorized third parties
7. Intellectual property
Zytek's content, design, code, brand and materials are the property of Zytek LLC. Specific deliverables created for you (content, design, website) become your property once the corresponding payment is completed.
8. Limitation of liability
To the maximum extent permitted by law, Zytek LLC is NOT liable for:
- Indirect, incidental or consequential damages
- Loss of profits, data or reputation
- Specific results of advertising campaigns (ROAS, leads, sales)
- Downtime of third-party platforms (Meta, Google, etc.)
Liability cap: the total amount paid by the client to Zytek in the 12 months prior to the event.
9. Indemnification
You commit to indemnify and hold harmless Zytek LLC, its employees and collaborators, against any claim arising from your misuse of the services.
10. Termination
Either party may terminate the contract with 30 days written notice. Zytek may terminate immediately for serious breach (non-payment, TOS violation, fraud).
11. Applicable law and jurisdiction
These terms are governed by the laws of the state of South Carolina, United States. Any dispute will be resolved in the competent courts of Charleston County, SC.
12. Modifications
We may modify these terms. We will notify substantial changes by email to active clients with 30 days notice. Continued use of services after notification implies acceptance of the new terms.
